A CHARTER ORDINANCE OF THE CITY OF COLWICH, KANSAS, EXEMPTING THE CITY OF COLWICH, KANSAS, PURSUANT TO THE HOME RULE AUTHORITY GRANTED IN ARTICLE 12, SECTION 5 OF THE CONSTITUTION OF THE STATE OF KANSAS, FROM THE PROHIBITION OF COLLECTING COURT COSTS, AS PROHIBITED BY K.S.A. 12-4112, AND PROVIDING IN LIEU THEREOF AUTHORITY TO IMPOSE COURT COSTS IN THE AMOUNT OF $40 IN ALL CASES INVOLVING A PLEA OR A FINDING BEFORE THE COLWICH, KANSAS, MUNICIPAL COURT JUDGE.
Section 1. The
City of Colwich, Kansas, by virtue of the power vested in it by Article 12,
Section 5, of the constitution of the State of Kansas, hereby elects to exempt
itself and hereby exempts itself from the provisions of K.S.A. 12-4112 inasmuch
as said statute prohibits the collection of costs for the administration of
justice in municipal court. The remaining portion of K.S.A. 12-4112 inasmuch as
it allows for the collection of witness fees and mileage shall not be affected
by the passage of this ordinance.
